Mother was approximately 23-24 weeks pregnant when her membranes ruptured and she went into labor. She was admitted to defendant's hospital, and labor was slowed initially, but baby went into fetal distress at about 24 weeks. She was very small and depressed at birth, and neonatal resuscitation was delayed before it was begun in earnest. Baby survived, but with permanent neurologic deficits.
