Plaintiff was a 60 year old man when he developed intermittent transient weakness of his arm with associated speech difficulties. He went to his primary care physician, who ordered a CT scan to "rule out intra-cranial lesion." The CT was positive for an ischemic lesion, but no follow-up was accomplished and no anticoagulation or surgery recommended. Plaintiff then suffered a major stroke, leading to permanent brain damage.
