This mother was monitored in labor electronically, but the nurses and the attending obstetrician failed to recognize signs of fetal intolerance of labor. Eventually, they realized that the baby was not tolerating labor due to umbilical cord compression. By the time they decided to do a Cesarean section, however, the baby suffered severe distress. Ultimately, the baby had brain damage from lack of oxygen, leading to cerebral palsy, spastic quadriparesis, and developmental delay.

The obstetrician paid her full insurance policy limits to settle her portion of the case. The hospital paid the bulk of the rest of the settlement, while the neonatologist also contributed a significant amount.
