Plaintiff mother was 37 weeks pregnant when she was in a motor vehicle accident. She went to defendant hospital's emergency room, where she was evaluated for a ruptured spleen. Although the spleen was not ruptured, the liver was damaged. However, in addition, the placenta was damaged (placental abruption). By the time the placental abruption was recognized, the baby suffered asphyxia from lack of oxygen and ultimately, brain damage.
