Plaintiff sought a home birth from a lay midwife, with the assistance of a registered nurse. According to statute, lay midwives were to be "supervised" by obstetricians. Here, the midwife recommended an obstetrician for prenatal care, but he did not supervise her care. The baby was born at home, and suffered a shoulder dystocia. He was "stuck in the birth canal" for over 11 minutes, during which time, he suffered severe brain damage from lack of oxygen.
