LOS ANGELES JURY RENDERS VERDICT OF OVER $40,000,000 FOR KUSSMAN & WHITEHILL CLIENT.
Russell Kussman, M.D., J.D. recently took to trial the case of a five year old child with severe brain damage due to a Herpes encephalitis infection. In late June, 2006, a West Los Angeles jury found that an emergency room doctor should have ordered a CT scan of the brain once he learned the child's history of fever and focal seizures. Dr. Kussman contended that the failure to do a CT scan led to an inordinate delay in making the correct diagnosis. This led to an unfortunate delay in treatment, with resultant permanent brain damage. The jury agreed, and awarded the plaintiff sufficient funds to provide him with care for the rest of his life. The verdict was for over $40,000,000 (total value), with a present cash value of $6,541,280.
